The information recorded and stored is intended for use by the Operator and is communicated only to the following recipients, with the consent of the data subject: the data subject, the operator’s proxy, the operator’s contractual partners, and other companies in the same group as the operator. The central and local public authorities to whom this information is communicated, within a special investigation competence, will not be considered as recipients and, consequently, the consent of the data subject is not necessary (for example: courts of law, prosecutors, criminal investigation bodies, etc.).
The data subject has the right to object at any time, for well-founded and legitimate reasons, to the data concerning them being processed, with exceptions provided by law. In case of justified opposition, the data processing can no longer target the data in question. Also, the data subject has the right to object, at any time and free of charge, without any justification, to the data concerning them being processed for direct marketing purposes, on behalf of the Operator or a third party, or to be disclosed to third parties. For this, the data subject will address a written, dated, and signed request, and the measures taken by the Operator will be communicated within 15 (fifteen) days from the date of the request.

The personal data of each User and/or Buyer is confidential and will be used by Stonearc Design Production Srl, only for the stated purpose of this site (purchasing products, information, visiting, expressing opinions), in compliance with the provisions of the General Data Protection Regulation no. 679/2016 regarding “The protection of natural persons with regard to the processing of personal data”. Our company undertakes not to provide, directly or indirectly, this data to a third party, apart from the exceptions regulated and provided by law.
Users’ personal data is stored in a database, protected with a username and password. Also, customers’ login data on the site is stored encrypted in this database.

You are also recognized the right to address justice. If some of the data about you is incorrect, please inform us as soon as possible.
All the data collected following the registration on the site www.stonearc.ro of the users are processed and processed according to the existing legal regulations on the territory of Romania. Buyer: natural or legal person who issues an Order.
Product: any good to be supplied by the Seller to the Buyer.
Order: an electronic document that intervenes as a form of communication between the Seller and the Buyer, through which the Seller agrees to deliver the Products, and the Buyer agrees to receive and pay for these Products.
Contract: by concluding the distance sale-purchase contract, the Buyer declares that they expressly accept the terms and conditions below and undertakes to comply with them.
Intellectual Property Rights: all intangible rights, such as know-how, copyright, design right, model right, patents, registered trademarks, and domain name registrations for any of the above.
The general terms and conditions will apply to all sales of products by Stonearc Design Production Srl, through the website www.stonearc.ro, and may be modified unilaterally, at any time.
II. Products
The images and specifications of the products are for illustrative purposes, the aim being to create an indicative representation of them, the reconstructed decorative stone usually presenting color variations, shade, veining, texture, density, as well as cracks/veins and grouted and/or ungrouted voids/holes.
Decorative brick products, window sills may have thickness and size deviations of up to a maximum of +/- 2 mm.
Any stone and decorative brick product, window sills must be handled and transported with increased care, the Seller only replacing those products broken or damaged due to their fault.
Stone and decorative brick products are cleaned/washed either with clean water or with a professional cleaning solution (NEVER use solutions such as vinegar, chlorine, descaler, etc.).
III. Creating an account/purchasing
In order to place an order online, the Buyer can fill out the order form (from the “Request a price offer” section). Stonearc Design Production Srl reserves the right to restrict access to the site or to certain sections of the site if the information provided by the Buyer proves to be false, incomplete, unclear, or outdated.
Delivery can be done by courier or through the agreed partners (transport companies).
Payment methods:
Cash or bank transfer.
Payment order.
iv. contractual documents
By placing an order on the website www.stonearc.ro, the Buyer agrees to the form of communication used by the Seller to conduct its operations. The following are considered contractual documents:
The order (together with clear mentions of delivery and billing data) and its specific conditions;
The Buyer’s specifications (where applicable);
Terms and conditions.
If the Seller confirms the order by issuing a proforma invoice, this implies full acceptance of its terms. The moment of concluding the distance contract with the individual or legal entity is considered the moment of Order confirmation by the Seller. The general terms and conditions of sale will form the basis of the Contract thus concluded.
v. Payments
The products are available for pickup/delivery from the Seller’s warehouse (Botești, NT, Str. Teilor). The purchased products can be delivered for a fee to the address requested by the Buyer.
The Buyer can complete the price request form, and following this, Stonearc Design Production Srl will prepare a price offer containing all the details regarding products, quantities, and price.
Orders are always paid in full before delivery, with payments considered valid only after the amounts have been received in the Seller’s account.
Goods in stock will be delivered within a maximum of 3 (three) working days from the date of receipt of the order value in the Seller’s account. For special pieces, which will be cut/processed according to the Buyer’s personalized dimensions, the delivery term and cost will be specified in the proforma invoice.
If the Buyer or a representative thereof is not at the delivery address and/or does not have equipment/personnel for unloading the goods, they will pay the return costs within a maximum of 3 (three) days from the issuance of the related invoice. In case of redelivery, the Buyer will pay the related redelivery cost in advance.
vi. Delivery and receipt
The goods are received quantitatively and qualitatively upon their collection from the Seller’s warehouse (Botești, NT, Str. Teilor), based on the tax invoice in which the ordered products are mentioned, a document obtained in advance from the Seller’s headquarters (Botești, NT, Str. Teilor). The delivery/collection of the goods from the Seller’s warehouse will be done on the same day as the date mentioned in the related tax invoice.
If the transport/delivery is done by the Seller to the address indicated by the Buyer, the goods are received quantitatively and qualitatively upon their unloading, the Buyer or their representative signing the tax invoice and/or the goods accompanying document or any other document of the transport company (e.g., CMR) without objections. Any subsequent quantitative or qualitative complaint will be considered late and will not be accepted.
The Seller is not responsible and does not owe damages of any kind to the Buyer when the products are damaged as a result of the Buyer’s actions during unloading operations, as unloading is the Buyer’s responsibility. Also, the personnel ensuring the delivery are not obliged to handle the delivered products. The responsibility for maneuvering the goods from the means of transport to the building premises lies with the Buyer. Product delivery is done with a vehicle that does NOT have a lift or crane. The delivery interval is 08:00 – 17:30, from Monday to Friday.
The Buyer is obliged to specify whether the location where the products will be delivered allows the entry and parking of large tonnage freight transport vehicles. The access road to the delivery location must be accessible and paved.
vii. Risks and responsibilities
Stonearc Design Production Srl offers no guarantee and assumes no responsibility for interruptions, loss of connection, or errors occurring when accessing the website www.stonearc.ro, as well as for damages caused by the insecurity of the line or devices from which the person connects to the site.
Except for situations agreed differently between the Seller and the Buyer, the Seller is discharged of the risks and responsibilities associated with the products at the time of their delivery to the courier/transport company with which the Seller collaborates or to the Buyer’s representative. The Seller ensures the proper packaging of the products and the transmission of the accompanying documents.
The Seller delivers the products on the territory of Romania, undertaking to ship them door-to-door to the Buyer.
viii. Return policy
The Buyer may refuse the delivered products if they do not correspond to the specifications mentioned in the order. In this case, Stonearc Design Production Srl assumes the obligation to bring the products into conformity.
The returned product must be in the same condition in which it was delivered (including placed on pallets), in the original packaging (box, pallet, etc.), including the original packaging method (e.g., straps, wrapping and other elements that ensure proper anchoring, without which the products may be damaged during transport and cannot be subsequently put back on sale), with all the accessories that accompanied it, as well as the tax invoice and proof of payment in original. The packaging must be intact, undamaged, without traces of blows and with the initial label. Otherwise, the return is not accepted.
The return of products is made within 14 calendar days from the date of their delivery, to the Seller’s warehouse (Botești, NT, Str. Teilor), the Buyer bearing both the additional costs related to the return and the initial delivery fee. The 14-day return applies only to products ordered online.
The refund of amounts is made within a maximum of 14 calendar days from the physical (quantitative and qualitative) receipt of the products by Stonearc Design Production Srl, in its warehouse in Botești, NT, Str. Teilor, to the bank account indicated by the Buyer.
Returns are not accepted:
Beyond the term of 14 calendar days from the date of delivery of the products;
For products executed or which have been the subject of a special import operation, based on a personalized order, or for special pieces cut from slabs or plates (e.g., countertops, steps, risers, baseboards, window sills, etc.) to the Buyer’s personalized dimensions;
For products that show signs of damage or wear;
For products that have been used or show traces of adhesive;
Partial – only for a part of the ordered products;
For products that have chips or breaks in a percentage of up to a maximum of 5% of the quantity delivered.
ix. Transfer of ownership
Ownership of the products will be transferred on the date of receipt of their price by the Seller.
x. Responsibility
The Seller cannot be held responsible for damages of any kind that the Buyer or any third party may suffer as a result of the Buyer’s fulfillment of any obligation arising from the order, as well as for damages that occur as a result of the use of the products after delivery, including, but not limited to, the loss of the products.
xi. Guarantees
All products sold on the website www.stonearc.ro benefit from warranty conditions in accordance with the legislation in force and the commercial policies of the manufacturers. To benefit from the warranty, the Buyer must have the tax invoice and proof of payment in original.
xii. Force majeure
Neither party will be liable for the non-performance of its contractual obligations if this is caused by a force majeure event.
In the event that the force majeure lasts more than 30 (thirty) days, either party has the right to unilaterally terminate the contract, without being subject to any penalty.
xiii. Applicable law
Any disputes arising between the Buyer and Stonearc Design Production Srl will be resolved amicably (by e-mail or telephone, with the designated contact person). If amicable settlement is not possible, the disputes will be resolved by the competent courts in Iași.
Legislation
The terms and conditions of use are subject to Romanian law. In case of litigation, an amicable resolution will first be attempted, within 30 (thirty) working days from the registration of the complaint at the headquarters of Stonearc Design Production Srl.
If an agreement is not reached within the mentioned term, the conflict will be resolved by the competent court at the registered office of the site administrator, in accordance with the Romanian legislation in force.
